Welcome to EcoPly Living! These Terms & Conditions ("Terms") govern your access to and use of the EcoPly Living website (ecoplyliving.com) and all related services, products, and content provided by EcoPly Living. By accessing or using our website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our website or services.
EcoPly Living is a contemporary furniture design and sales brand focused on sustainable materials. We provide an online platform for browsing, configuring, and purchasing eco-friendly furniture, as well as accessing design consultations and related content. These Terms constitute a legally binding agreement between you and EcoPly Living.
1. Acceptance of Terms
By accessing and using the EcoPly Living website, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. These Terms apply to all visitors, users, and others who access or use the Service.
If you are using the Service on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms and that by accepting these Terms, you are doing so on behalf of that entity. In such a case, "you" and "your" will refer to that entity.

EcoPly Living reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. We will indicate the "Last Updated" date at the top of these Terms.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
3. User Accounts
3.1. Account Creation
To access certain features of the Service, such as placing orders or managing custom designs, you may be required to create an account. You agree to provide accurate, complete, and current information during the registration process and to update such information to keep it accurate, complete, and current.
3.2. Account Security
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3.3. Account Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
4. Product Information & Pricing
4.1. Product Descriptions
EcoPly Living strives to ensure that all product descriptions, images, and specifications on our website are as accurate as possible. However, we do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. Natural variations in wood grain, color, and finish are inherent to our sustainable materials (EcoPly, reclaimed wood, FSC-certified wood) and are not considered defects. Actual products may vary slightly from the images due to photographic lighting sources or your monitor settings.
4.2. Pricing
All prices displayed on the EcoPly Living website are in the local currency indicated and are subject to change without notice. While we strive for accuracy, pricing errors may occur. In the event of a pricing error, we reserve the right to cancel any orders placed for the product at the incorrect price, even if the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will issue a credit to your credit card account in the amount of the incorrect price.
Prices do not include applicable taxes, shipping, or installation fees unless explicitly stated. These additional charges will be calculated and displayed at checkout.
5. Orders & Payment
5.1. Order Acceptance
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. EcoPly Living reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.
5.2. Payment
All payments are processed securely through third-party payment gateways. We accept major credit cards and other payment methods as indicated on our website. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.
6. Shipping & Delivery
6.1. Delivery Zones
EcoPly Living offers free delivery and installation in select zones. Please check our website or contact customer service to confirm if your location falls within our service zones. For locations outside these zones, additional shipping fees may apply, which will be communicated to you before order confirmation.
6.2. Delivery Times
Estimated delivery times are provided for your convenience and are not guaranteed. Actual delivery times may vary due to factors beyond our control, including but not limited to manufacturing delays, shipping carrier issues, weather conditions, or unforeseen circumstances. We will make reasonable efforts to keep you informed of any significant delays.
6.3. Inspection Upon Delivery
Upon delivery, it is your responsibility to inspect the furniture for any damages or discrepancies before signing the delivery receipt. If you notice any damage, please make a clear notation on the delivery receipt and contact our customer service immediately (within 24-48 hours) with photographic evidence. Failure to do so may affect your ability to claim damages.
7. Returns & Refunds
7.1. General Policy
EcoPly Living is committed to your satisfaction. Our return and refund policy is detailed on a separate "Returns" page on our website. Please review this policy carefully before making a purchase. Generally, returns are accepted for defective or damaged items reported within a specified timeframe, or for certain non-custom products within a cooling-off period, subject to conditions.
7.2. Custom Orders
Due to the personalized nature of custom-designed furniture, these orders are generally non-refundable and cannot be returned unless there is a manufacturing defect or significant deviation from the approved design specifications. Any issues with custom orders must be reported immediately upon delivery.
8. Intellectual Property
8.1. Ownership
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of EcoPly Living and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of EcoPly Living.
8.2. User-Generated Content
By submitting any content (e.g., reviews, photos, design ideas) to EcoPly Living, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. You represent and warrant that you own or control all rights to the content you submit and that the use of your content by EcoPly Living will not infringe upon or violate the rights of any third party.
9. User Conduct
You agree to use the EcoPly Living website and services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. Prohibited behavior includes but is not limited to:
- Engaging in any activity that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
- Uploading, posting, or transmitting any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships.
- Uploading, posting, or transmitting any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
- Interfering with or disrupting the Service or servers or networks connected to the Service.
- Attempting to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service, through hacking, password mining, or any other means.
- Collecting or storing personal data about other users without their express consent.
10. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
EcoPly Living, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
While we offer a lifetime termite-proof warranty as a specific product feature, this does not extend to general warranties on the overall Service or other aspects of the furniture beyond termite resistance as specified in our warranty documentation.
11. Limitation of Liability
In no event shall EcoPly Living, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
12. Indemnification
You agree to defend, indemnify, and hold harmless EcoPly Living and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; or b) a breach of these Terms.
13. Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration in New Delhi, India, in accordance with the provisions of the Arbitration and Conciliation Act, 1996, or any statutory modification or re-enactment thereof for the time being in force. The language of the arbitration shall be English.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
15. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and any other policies or operating rules posted by us on this site or in respect to the Service, constitute the entire agreement and understanding between you and EcoPly Living concerning your use of the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.
